These Terms govern your access to and use of Creatoll, including associated websites, applications, APIs, and services operated by Visit Maldives Corporation Limited (VMC).
By creating an account or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.
Platform: the Creatoll web application, APIs, and associated services.
Client: a user who licenses VMC assets or purchases Creator assets (Individual, Business, or Government).
Creator: a user who uploads and may sell content via the marketplace.
VMC Library: media assets owned and uploaded by VMC.
Marketplace: area where creator-uploaded and select VMC assets are available for purchase/free download.
License Request: formal request to license VMC Library assets for a specific purpose and duration.
Agreement: legal document generated from templates that must be accepted before license grant.
Wallet/Payout: creator earnings ledger and transfer process to verified bank accounts.
Presigned URL: time-limited secure link for entitled downloads.
3.1 Eligibility
You must be at least 18 years old (or legal age of majority in your jurisdiction).
3.2 Account Creation
You may register with email/password (with email verification) or Google OAuth.
3.3 Account Accuracy
You are responsible for keeping account information accurate and up to date.
3.4 Account Security
You are responsible for safeguarding credentials and notifying VMC of unauthorized use.
3.5 One Account Per Person/Entity
Each individual/entity may maintain only one account; duplicates may be suspended or terminated.
4.1 Client Types
Clients must select a type: Individual, Business, or Government, with required organization details where applicable.
4.2 Nationality and Currency
Nationality (ISO country code) determines currency: MV uses MVR; foreign clients use USD.
After verification, nationality changes require VMC support review.
4.3 Verification
Verification statuses: Pending, Verified, Rejected.
Unverified/rejected clients cannot submit VMC license requests or make marketplace purchases.
5.1 Becoming a Creator
Authenticated clients may apply for Creator role (subject to approval requirements).
5.2 Creator Profile
Creators manage display name, bio, avatar, and profile visibility settings.
5.3 Bank and Payout Details
Payout bank details are verified by VMC Finance (Pending, Verified, Rejected).
Verified bank details are locked and require support intervention to update.
5.4 Creator Obligations
Creators must own necessary rights and ensure uploads are lawful, non-infringing, and not harmful/objectionable.
6.1 License Requests
Verified clients may request VMC Library licenses with project purpose, duration, and selected assets.
Creator-uploaded assets are not eligible for VMC license requests.
6.2 Quotas and Limits
Per-request item limits and global active-item quotas apply by client type.
6.3 Extended Duration Review
Requests above the configured duration threshold may require admin approval.
6.4 Legal Agreements
Agreement acceptance is mandatory and recorded with timestamp, IP, and device metadata.
6.5/6.6 License Window and Expiry
Downloads are available only within the license window; expired licenses remain in history and release quota.
7.1 Browsing and Purchasing
Clients may browse and acquire creator content and selected VMC marketplace content.
7.2 Free Assets
Free assets are transacted immediately with direct entitlement grant.
7.3 Paid Assets
Paid assets support BML Connect card payments and manual bank transfer slip verification.
VMC may suspend accounts and reverse transactions for suspected fraud or falsified payment documents.
7.4 Currency and Pricing
Prices are shown in client currency (MVR/USD), with conversion where needed.
7.5 Terms Acceptance
Marketplace terms must be accepted per version and re-accepted when updated.
7.6 Download Entitlements
Successful purchases grant download entitlements via time-limited presigned URLs.
7.7 Refund and Cancellation
Refunds and cancellations are not supported. All transactions are final.
7.8 Transaction Records
Customers are advised to retain a copy of their transaction records for their reference.
8.1 Revenue Split
Applicable deductions include GST (default 8%) and VMC commission (default 30%), with net earnings credited to Creator wallet.
Example: MVR 100 sale -> GST MVR 8, commission MVR 30, net MVR 62.
8.2 Wallet
Wallet tracks net sales, payout requests, approved payouts, and available balance.
8.3 Payouts
Payout requests are finance-reviewed before transfer to verified bank accounts.
8.4 Fee Transparency
Current fee rates and sample calculations are available in Creator interfaces and fee endpoints.
VMC may run themed contests with specific rules, submission windows, and prizes.
Submissions must be newly uploaded for contest use and may be moderated before public visibility.
Winner selection may use public voting, judging panel decisions, or hybrid methods.
Contest entries, votes, and results may be retained for historical and analytics use.
VMC retains ownership of platform IP and VMC library assets.
Creators retain ownership of uploaded content but grant VMC platform distribution/promotional rights.
Clients may only use licensed/purchased content within granted scope and applicable terms.
Prohibited actions include unlawful use, IP/privacy infringement, malware upload, unauthorized access attempts, security circumvention, bot/scraper abuse, impersonation, infrastructure abuse, payment fraud, and unauthorized redistribution/sub-licensing.
VMC may suspend/terminate accounts for policy violations, fraud, failed verification, or extended inactivity.
Users may request account deletion, subject to handling under Privacy Policy and settlement of outstanding obligations.
Upon termination, platform access ends; surviving clauses remain enforceable.
The Platform is provided on an 'AS IS' and 'AS AVAILABLE' basis.
VMC disclaims warranties to the maximum extent permitted by law, including merchantability, fitness for purpose, and non-infringement.
To the maximum extent permitted by law, VMC is not liable for indirect, incidental, special, consequential, or punitive damages.
Aggregate liability is capped to amounts paid by you for relevant services in the preceding 12 months.
You agree to indemnify and hold VMC and its personnel harmless from claims/losses arising from your platform use, term breaches, third-party rights violations, or uploaded/distributed content.
Parties should first attempt informal dispute resolution through VMC contact channels.
These Terms are governed by Republic of Maldives law and disputes are subject to exclusive Maldivian court jurisdiction.
VMC may modify these Terms; material changes will be communicated on-platform and/or via email.
Continued use after changes constitutes acceptance; users who disagree must discontinue use and may request deletion.
These Terms, Privacy Policy, Cookie Policy, and applicable agreements/marketplace terms form the complete agreement.
Precedence in conflicts: License Agreement, Marketplace Terms, Terms of Service, Privacy Policy.
Includes severability, waiver, assignment, and force majeure clauses.
